Terms of sale

  1. Terms Control/Rejection of Conflicting Terms. These terms govern all sales. By placing an order, submitting payment, or delivering a Purchase Order to the Seller, the Buyer agrees to the conditions. The Seller’s offer to sell Goods to the Buyer relies on this acceptance. All additional terms are rejected, including those contained in purchase orders issued by the Buyer to the Seller.
  2. Payment Terms. Unless a written agreement between the Seller and the Buyer states otherwise, all orders must be paid in full before the Seller ships any products covered by these Terms and Conditions (“Goods”). If the Buyer pays with a check that is not a cashier’s check, the Seller reserves the right to delay shipping for a reasonable time, as determined solely by the Seller.
  3. Taxes. Prices do not include sales tax, use tax, VAT, excise tax, or any other taxes or government charges related to the goods' production, sale, distribution, or delivery. The final invoice will include all applicable taxes and government charges. The seller is responsible for the proper remittance of these taxes and charges.
  4. Shipping. Unless otherwise agreed in writing by both the Seller and Buyer, shipment terms are F.O.B. Origin, Freight Prepaid, and Add. The choice of carrier shall be at the Seller's sole discretion.
  5. Returns/Cancellations

    5.1 Product Returns Process

    a. If you have received your product within the last 30 calendar days, you can initiate a return by contacting our customer service.

    b. Our Support Team will assess whether your order is eligible for a return. Once confirmed, we will issue a Return Material Authorization (RMA) number and provide you with a prepaid return shipping label (the Support Team will determine the label). We will also provide instructions on how to package the product safely and correctly. Please only ship the product once you have received the proper packaging instructions. Make sure to mark the RMA number on the package and include your proof of purchase date.

    c. Sheltent will process your return request using our Return Policy.

    d. Please ensure you return the items and the RMA confirmation from the Sheltent Customer Support Team. For returns without confirmation, the refund or replacement may not be processed.

    5.2 Policy of Refunds & Replacements

    a. For returns of orders within the US, if the product is in good condition, we will charge a transaction fee based on the payment method used (2.6% for credit card users, 3.6% for PayPal users, and 3.5% for Affirm users) + the shipping cost. If there are quality issues with your product, we will provide a full refund or one complimentary replacement after you receive the items.

    b. After Sheltent receives your refund request, we will process the refund within 14 business days of receiving your product. You will receive an email notification once your refund has been processed. If you do not receive the refund after 14 business days, please get in touch with service@sheltent.com.

    c. Once Sheltent receives your request for a product replacement, we will send a replacement product within 7 business days, provided we have sufficient stock. Once the replacement has been dispatched, you will receive an email with the logistics information.

  6. Force Majeure. The Seller will not be liable for any performance delays if events beyond the Seller’s control directly or indirectly cause those delays. Such events include, but are not limited to, fires, floods, terrorism, accidents, riots, war, government interference, embargoes, strikes, labor shortages, shortages of materials or supplies, inadequate transportation facilities, or any other unforeseen circumstances.
  7. Damages. The Buyer is solely responsible for any damages from improperly ballasted or staked tents. The Buyer acknowledges that tents must be ballasted or staked according to the Seller’s recommendations. The Seller will not be liable for any material, personal, or financial losses incurred.
  8. Commitment to Cure. We are dedicated to our artistry and our customers. If there are any issues with the tent top or parts, we will resolve them before their initial use. Customers must notify us of any problems within 30 days of receiving the goods. We cannot address requests for treatment after 14 days of receipt.
  9. Limitation of Damages. The seller shall not be liable for indirect, incidental, consequential, exemplary, or punitive damages that result from or arise in connection with any act or omission by the seller relating to a breach of these Terms and Conditions or in any way related to the design, manufacture, delivery, or use of the goods. The seller’s liability, regardless of the grounds, shall be limited to the amount paid by the buyer for the goods.
  10. Limitation of Actions. Notwithstanding any statute of limitations, no claim shall be filed or brought against the seller for any breach of these terms and conditions more than two (2) years after the buyer receives the goods.
  11. Nature of Goods as Temporary Structures. Each good is classified as a temporary structure or part of a temporary structure that is not intended to comply with building or other codes. The buyer assumes all risks associated with the use of these goods.
  12. Modifications. These Terms and Conditions may not be amended, modified, terminated, or repudiated, in whole or in part, except in writing and signed by both the Seller and the Buyer.
  13. Remedies Not Exclusive. No remedy provided to the Seller in these Terms of Sale is exclusive of any other remedies available to the Seller.
  14. Assignment. The Buyer cannot assign any rights, duties, or obligations without obtaining written consent from the Seller.
  15. Cost of Collection. The Buyer is responsible for all costs incurred by the Seller due to any breach of these Terms of Sale by the Buyer, including the Seller’s actual attorney’s fees.
  16. Authority of Signers. Each individual accepting these Terms of Sale represents and warrants that they are duly authorized to do so.
  17. Counterparts & Facsimile Signatures. These Terms of Sale may be signed in counterparts. Facsimile and electronic signatures have the same legal effect as original signatures. Placing and paying for an order online also acknowledges and agrees to these Terms and Conditions.
